The use of Fairness and Machine Learning in Judicial Decision-Making Processes: a Systematic Literature Review

Abstract:
The use of fairness has been pointed out as an alternative to avoid or mitigate biases in decision-making processes that use machine learning. This work aims to identify, evaluate and interpret studies that present details about the method, tools and use of fairness tests. This is a systematic review study, through the selection of articles on the topic of fairness and machine learning in judicial decision-making processes. As a result, it was possible to understand the state of the art of the use of fairness in the context of the justice system, analyzing the quality, challenges and difficulties found in the literature.
