in charge with cultural heritage will guarantee the study and the documentation
of this cultural manifestation with scientific criteria and will record the available
displays to material supports that guarantee their survival. In spite of the high
relevancy of the Court, the day of the public meeting of the Court has turned,
since many years already, into a tourist attraction, with the sole purpose of
taking pictures of the Trustees. Tourists tend to attend these meetings only for
the visual staging of the procedure (apparel, location, calling out, language)
but mostly ignore the deep meaning of it, and see it as a mere folklore show. It
is our opinion that tourists are not aware of the deep roots that this Court has
on local history, economy and tradition, mainly due to a lack of information.
Visitors would enhance their experience if accurate information were facilitated,
as they would link the public performance of the Court to the legal implications
and to the importance of water in the Valencian culture.
El Tribunal de las Aguas de la Vega de Valencia
Se trata de un Tribunal de origen milenario que resuelve los conflictos en materia
de aguas de las acequias que riegan la Huerta Valenciana [1]. De especial
relevancia resulta la doble actuación del Tribunal: jurídica y administrativa en
cuanto a la importancia del regadío en la zona de la huerta. Sus orígenes en
la época islámica [2], y pese a las vicisitudes, su pervivencia ha llegado hasta
la época actual, en la que el Tribunal es el máximo exponente de un sistema
de resolución de conflictos caracterizado por las siguientes notas:
a) Oralidad. Todo el procedimiento se desarrolla oralmente, tanto la
denuncia, como las alegaciones, así como la sentencia, aunque se
recoge ésta última por escrito, de forma breve.
b) Concentración. No se realiza en diversos actos. El Tribunal en el
momento de resolver tiene toda la información para dictar la sentencia
en el momento.
c) Rapidez. Si el denunciado se persona, se resuelve en ese mismo
momento; si no, en las dos semanas siguientes, a la tercera, se le juzga
en rebeldía, sin su presencia.
d) Economía. No conlleva costes económicos, ya que los Síndicos de
las acequias no perciben ninguna remuneración. La multa que estipule
